“Drafting Charitable Gift Agreements That Stand the Test of Time”

Donors increasingly want significant control and input over the use of their charitable gifts.  This session will review the legal and practical issues impacting the negotiation, drafting and enforcement of a charitable gift agreement, including race and gender-based grant making, donor involvement post-gift, the enforceability of charitable pledges and standing to sue to enforce the terms of the gift.

 

Alan F. Rothschild, Jr., a Columbus, Georgia native, has practiced estate planning and nonprofit law in Columbus and Atlanta for over 35 years.  He is past Chair of the American Bar Association’s Real Property, Trust and Estate Law Section and a Fellow of the American College of Trust and Estate Counsel and the American College of Tax Counsel.  He serves on the Heckerling Estate Planning Institute Advisory Committee, chaired the Board of Trustees of the Southern Federal Tax Institute in 2021-22, and is an adjunct professor at the University of Miami School of Law, where he teaches a course on the law of tax exempt organizations.

Alan has served as President of the Board of Trustees of The Columbus Museum and as Chair of the Board of Advisors of the Georgia Museum of Art in Athens.  He has also served on the boards of the Georgia Trust for Historic Preservation and the Georgia Humanities Council and is a founding board member and long-time outside counsel for the Community Foundation of the Chattahoochee Valley.

 "Donor Advised Fund Deep Dive"

Donor advised fund (“DAF”) popularity continues to grow as the preferred charitable giving vehicle for many individuals, families and organizations. Despite this increasing popularity – there are now estimated to be more than 1.9 million DAF accounts in the U.S. – many remain unaware or uncertain about what DAFs are and how they operate. In this session, we will do a deep dive into donor advised funds, including a high-level overview of how DAFs work across sponsoring charities. We will spend time examining donor advised funds from the perspective of the Community Foundation for Greater Atlanta, including the various personas and motivations of donors who establish DAFs with Community Foundation. Finally, we will discuss the status of proposed regulations introduced in 2023 intended to further regulate donor advised funds.



Tim Bresnahan, Vice President, Advancement and Philanthropic ServicesAs Vice President of Advancement and Philanthropic Services, Tim leads the Foundation’s strategic work to inspire philanthropy within and throughout the Atlanta region and ensures the donors to the Foundation receive exceptional stewardship and advice. 

Prior to joining the Community Foundation for Greater Atlanta, Tim spent more than a decade in roles within wealth management and community foundations. As Associate Director of Philanthropic Services at Northern Trust, Tim oversaw the Northern Trust Charitable Giving Programs, one of the few national donor advised fund programs at a wealth management firm that is run in partnership with a community foundation. He also co-chaired the Young Professional Advisor Committee at The Chicago Community Trust.

Following his time at Northern Trust, Tim joined The Chicago Community Trust as its Senior Director of Gift Planning, where he oversaw all asset development and professional advisor engagement. During his tenure, the Community Trust grew its annual contributions to more than $1.6 billion. Tim also led the re-design of the Northern Trust Charitable Giving Program in partnership with the Community Trust, growing that program to more than 1,000 funds and more than $1 billion in AUM.

Tim earned a Bachelor of Science in Foreign Service degree from Georgetown University and a JD degree from the Chicago-Kent College of Law.

In his downtime, Tim loves spending time with his husband and daughter and exploring Atlanta’s vibrant arts and food scenes.
